Welcome to Zyathi. These Terms of Use ("Terms") constitute a legally binding agreement between you and Zyathi Technologies Private Limited ("Zyathi", "we", "our", or "us") governing your access to and use of the Zyathi mobile application, website at zyathi.com, WhatsApp service, and all associated services (collectively, the "Platform").

1. Acceptance of Terms

By creating an account, accessing, or using the Platform, you agree to be bound by these Terms and our Privacy Policy and Cookie Policy. If you do not agree to all of these Terms, you must not use the Platform.

If you are using the Platform on behalf of another person (such as a family member under a Family Plan), you represent that you have authority to bind that person to these Terms and accept them on their behalf.

2. Eligibility

To use the Platform you must:

  • Be at least 18 years of age, or 13–17 years of age with verified parental/guardian consent.
  • Be a resident of India or accessing the Platform from India.
  • Provide accurate registration information and maintain its accuracy.
  • Not have been previously banned or suspended from the Platform.

3. Medical Disclaimer

IMPORTANT: Zyathi is a wellness and health tracking platform. The content, AI guidance from Sakhi, nutrition plans, and health information provided on the Platform are for informational and educational purposes only.

The Platform is NOT a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of a qualified physician, gynaecologist, or other licensed health professional for any medical condition. In a medical emergency, call 112 (India Emergency Services) immediately.

4. User Accounts

4.1 Account Creation: You must provide a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your login credentials.

4.2 Account Responsibility: You are solely responsible for all activity that occurs under your account. Notify us immediately at support@zyathi.com if you suspect unauthorised access.

4.3 Family Plans: Under a Family Plan, the account holder may add up to 3 additional women. Each family member's health data remains private to them unless they explicitly enable family sharing within the app.

5. Subscription & Billing

5.1 Plans and Pricing:

  • Her Plan: ₹199/month or ₹1,999/year (1 user)
  • Family Plan: ₹499/month or ₹4,999/year (up to 4 users)
  • Gift Plan: ₹1,999 one-time annual gift

All prices are inclusive of applicable GST. Prices may change with 30 days' notice.

5.2 Billing: Subscriptions are billed in advance on a monthly or annual basis. By subscribing, you authorise recurring charges to your chosen payment method.

5.3 Cancellation: You may cancel your subscription at any time through the app settings. Cancellation takes effect at the end of the current billing period.

5.4 Gift Plans: Gift subscriptions are non-refundable once the recipient has activated the plan. Unactivated gifts may be refunded within 14 days of purchase.

6. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable Indian law.
  • Share, sell, or transfer your account or subscription to another person.
  • Attempt to reverse-engineer, decompile, or create derivative works from the Platform.
  • Upload or transmit malicious code, viruses, or any harmful content.
  • Use automated tools, bots, or scrapers to access the Platform without written permission.
  • Submit false, misleading, or fraudulent health information.

7. Intellectual Property

All content on the Platform — including the Zyathi name and logo, Sakhi AI, health articles, UI design, code, and Hindi-language content — is owned by or licensed to Zyathi and protected by Indian and international intellectual property laws. You may not reproduce or distribute Platform content without our prior written consent.

8. Third-Party Services

The Platform integrates with third-party services including WhatsApp Business API and payment gateways. Your use of these services is subject to the respective third-party terms and privacy policies.

9. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Zyathi shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total aggregate liability for any claim shall not exceed the total subscription fees you paid to us in the three months preceding the claim.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, including the Information Technology Act, 2000, the Consumer Protection Act, 2019, and the Digital Personal Data Protection Act, 2023. Any dispute shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to binding arbitration in Bengaluru, Karnataka.

11. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or in-app notification at least 14 days before the changes take effect.
